JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner seeks regular bail in connection with Atri PS case no. 150 of 2017 registered for the offences punishable under Sections 414, 420, 467 and 468/34 of Indian Penal Code.
The accusation against the petitioner is that when the police force were on patrolling, three persons were fleeing away leaving the motorcycle whereafter, they were apprehended and it transpired that the motorcycle which they had left, was a stolen one.
The learned counsel for the petitioner submits that no recovery has been made from the conscious possession of the petitioners, he does not have any criminal antecedent and similarly
Patna High Court Cr.Misc. No.53604 of 2017 (2) dt.09-11-2017 2/2 situated co-accused has already been granted bail vide order dated 20.09.2017 passed in Criminal Misc. no. 45964 of 2017. For the reasons mentioned hereinabove, the petitioner Subodh Manjhi is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Atri P.S. Case no. 150 of 2017.
