JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-06-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Nautan P.S. Case No. 534 of 2017 for the offence under Sections 437, 341, 384, 379, 504, 506 and 134 of the Indian Penal Code. Learned counsel for the petitioner would submit that the allegation against the petitioner is that he was involved in committing the theft of cow and calf and on being seen such occurrence by the father of the informant, he protested and then the accused persons abused the informant, his father and brother and threatened them with dire consequences. The petitioner is in custody since 13.11.2019.

Considering the fact that the petitioner has remained in custody for more than six months, the Court is inclined to

The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Cheif Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S. Case No. 534 of 2017, subject to the condition that on release, the petitioner shall render his service as volunteer in the District Health Centre for a period of three months in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately.
