1. Heard learned counsel for the appellant and learned Special P.P. for the State.
2. The learned counsel for the appellant submits that appellant is a person with clean antecedent and from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault or abuse is alleged against the appellant, but then, it is submitted that he has been made an accused merely because the informant alleges that he was also present at the place of occurrence when the occurrence is alleged to have taken place. It is very fairly submitted that police after investigation submitted charge-sheet. It is also submitted that thereafter the learned trial Court finding the allegation to be prima facie true took cognizance based on the
Patna High Court CR. APP (SJ) No.1223 of 2024(3) dt.10-09-2025 2/2 charge-sheet, as such, the appellant seeks permission to withdraw the present appeal with liberty to surrender before the learned trial Court and seek regular bail.
3. Permission is accorded.
4. Accordingly, instant appeal is dismissed as withdrawn.
5. It is made clear that if the appellant surrenders on or before 08.10.2025, in that event, the learned trial Court shall consider and dispose of the case on the same day. (Satyavrat Verma, J) vikash/- U T
