The petitioners seek bail in a case registered for offences punishable under sections 272 / 273/420/120B of the Indian Penal Code and section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, about 3200 litres of foreign liquor was recovered from a truck. It is further contended that, as per allegation, petitioner no. 1 is owner cum driver and petitioner no. 2 is cleaner of the truck. Petitioners claim that they are not owner of the said liquor. Petitioners further claim that they are having clean antecedents and are in

Patna High Court Cr.Misc. No.52219 of 2017(2) dt.09-11-2017 2/2 custody since 5.7.2017.

Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Saran at Chapra in connection with Manjhi P.S. Case No. 131 of 2017 with further conditions that one of the bailors of the petitioners must be the resident of State of Bihar.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
