The petitioner apprehends his arrest in connection with Complaint Case No. 213 of 2017 in which cognizance has been taken under Section 498A of the Indian Penal Code. The matter was referred for mediation before the Patna High Court Mediation and Concilliation Centre and from perusal of the report of learned Mediator as well as memorandum of agreement dated 23.08.2019, it appears that both parties have settled their dispute mutually and amicably. In view of the above and taking into consideration the fact that both parties have entered into memorandum of

No.17398 of 2019(5) dt.30-09-2019 2/2 agreement and have settled their dispute mutually and amicably, let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Banka in connection with Complaint Case No. 213 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner will abide by terms and conditions of the memorandum of agreement dated 23.08.2019.
