The petitioner seeks bail in connection with Laheria Sarai P.S. Case No. 16 of 2019 instituted for the offence under Section 414 of the I.P.C. and Section(s) 25(1-B)(A)/26/35 of Arms Act.
It is alleged in the written report that police intercepted one motorcycle and the driver of the motorcycle fled away after leaving the motorcycle. It is further alleged that petitioner was apprehended who was found sitting on the motorcycle and on search, one country made pistol, one live cartridge, rupees 5000/- and one Samsung mobile have been recovered from his possession.
Learned counsel for petitioner submits that petitioner
Patna High Court CR. MISC. No.22012 of 2019(2) dt.09-04-2019 2/2 has been made accused merely on suspicion. The aforesaid motorcycle does not belong to this petitioner. Petitioner is in custody since 16.01.2019 having clean antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheria Sarai P.S. Case No. 16 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
