The petitioner seeks bail in connection with Bhabua P.S. Case No. 500 of 2019 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Submission is that it would appear from the first information report that on the basis of the written report of the informant, Chandrashekhar Pandey, Bhabua P.S. Case No. 500 of 2019 was instituted on 22.08.2019 against unknown in respect to murder of his brother, Shashi Shekhar Pandey. In course of investigation, the name of the petitioner surfaced in the confessional statement of Manoj Chaubey and it is also said that the allegation that mobile of the petitioner was found near the deceased, Shashi Shekhar Pandey. No.16018 of 2020(2) dt.04-06-2020 2/2 that in fact petitioner is accused in four cases, as detailed in paragraph 3, due to that reason the police managed to implicate the petitioner in this case and the petitioner is in custody since 28.11.2019. More so, the police, on investigation, submitted the charge sheet.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bhabua P.S. Case No. 500 of 2019 to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua.
