JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 77(c) of 2018 instituted for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

It appears that on appearance of opposite party No.2 the matter was referred to the Patna High Court Mediation and Conciliation Centre vide order dated 3.5.2019 and the Mediator's report at Flag 'A' is available on the record which disclosed that the dispute

Patna High Court CR. MISC. No.16785 of 2019(4) dt.30-07-2019 2/3 between the parties has been resolved through the process of mediation and memorandum of agreement is also part of the report, that shows that both the parties are ready to live separately, the petitioner will not oppose the divorce on mutual consent filed by opposite party No.2 and they will withdraw the cases filed against each other.

In view of above facts and circumstances, the petitioner is directed to surrender by 9.8.2019 and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Danapur, in connection with Complaint Case No. 77(c) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition

Patna High Court CR. MISC. No.16785 of 2019(4) dt.30-07-2019 3/3 is that petitioner will abide by the terms of the agreement reached between the parties. It is also expected that opposite party No.2 shall also abide by the terms of the agreement reached between the parties. Let the report of the mediator along with the memorandum of agreement be communicated to the court concerned for needful.
