JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 13-03-2018 Heard learned counsel for the petitioner and State. The grievance of the petitioner in the writ application is non-consideration of her case for grant of promotion from L.E.S. to S.E.S. and consequential benefits.

Learned counsel for the petitioner submits that the respondents are required to consider the case of the petitioner for grant of promotion in accordance with the rule regulating such promotion and the dilly dally in the matter of decision is adversely affecting the interest of the petitioner.

In various paragraph of the writ application there is reference that the petitioner and others have filed representations, which is pending before the respondents.

Patna High Court CWJC No.2779 of 2016 dt.13-03-2018 2/2 Promotions are regulated by defenite set of norms or rules and respondents are required to consider the case for grant of promotion in accordance with the rules applicable or norms prevalent for grant of promotion.

Considering the grievance of the petitioner that the respondents are indecisive in the matter of finalization of the select list for promotion, the writ application is disposed of with a direction to the Director. Secondary Education, Government of Bihar (respondent no.3) to examine the case of the petitioner and pass appropriate order considering the seniority position of the petitioner for promotion to the post of S.E.S. The entire exercise in this regard must be completed within a maximum period of 4 months from the date of receipt/production of a copy of this order. It is needless to state here that the respondents may examine the claim of the petitioner and if the petitioner is found entitled for promotion, the consequential monetary benefits must reach the petitioner within a further period of two months.
