Petitioner seeks bail in Amdabad P.S. Case No. 137 of 2016 for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.
Informant is the brother of deceased who has alleged in the FIR that his sister who was married to one of the accused has been killed by strangulation.
Learned counsel for the petitioner submits that he is in no way related to the husband of the deceased and not related with the family of the husband of the deceased. It has been further submitted that the Father-in-Law and Mother-in-Law have been granted bail by a co-ordinate bench of this Court vide
Patna High Court Cr.Misc. No.52315 of 2017(2) dt.09-11-2017 2/2 order dated 21.09.2017 in Criminal Miscellaneous No. 40256 of 2017. Petitioner has got no criminal antecedent and is in custody since, 06.08.2017.
Learned APP for the State opposes the prayer for bail.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Katihar in connection with Amdabad P.S. Case No. 137 of 2016.
