The petitioner seeks bail in connection with Kartaha P.S. Case No. 92 of 2022 registered for the offence punishable under Sections 304B, 201, 341, 323, 504, 506, 120B / 34 of the Indian Penal Code.

As per the prosecution case, the daughter of informant who is the wife of petitioner's brother namely Anil Paswan has been murdered by the accused persons for non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that petitioner was living separately from the family of deceased and her husband and he had no concern with their daily affairs. There was love marriage between the deceased Kajal Kumari and Anil Paswan the brother of the petitioner. The petitioner is

Patna High Court CR. MISC. No.20283 of 2023(2) dt.17-05-2023 2/2 in jail custody since 12.01.2023 and he has no criminal antecedent. Further he has submitted that similarly situated coaccused Sagar Paswan, father-in-law of the deceased, has been granted regular bail by the Coordinate Bench of this Court vide order dated 11.05.2023 in Criminal Miscellaneous No. 16676 of 2023.

Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - III, Vaishali at Hajipur in connection with Kartaha P.S. Case No. 92 of 2022.
