2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 363, 366/34 of the Indian Penal Code and Section 8 of the POCSO Act, registered in connection with Gaunaha P.S. Case No. 200 of 2023.

3. The allegation against the petitioner along with others is of abducting the daughter of the informant.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. The victim girl has been recovered and

No.22419 of 2024(8) dt.10-09-2024 2/2 her statement has been recorded under Section 164 of the Cr.P.C. in which she stated that she herself went out from house as she was angry with her mother, which does not corroborate the prosecution case. Moreover, petitioner is a person of clean antecedent and he is in custody since 19.10.2023.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge-7th-cum-Special Judge, POCSO, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 200 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
