Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 147, 148, 149, 323, 307, 363, 365, 120B of the Indian Penal Code and Section 4 of the POCSO Act.

Allegation is that the accused persons forcibly lifted the daughter of the informant and fled away on their motorcycle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.11.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the

Patna High Court CR. MISC. No.15592 of 2020(2) dt.06-03-2020 2/2 petitioner has transpired in this case on disclosure made by coaccused. The victim has been recovered. Her statement under Section 164 of Cr.P.C. has been recorded. She has not named this petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge I-cum-Special Judge, POCSO Act, Samastipur in connection with Tajpur P.S. case No.336 of 2017.
