JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,504,307,379 and 427/34 of the Indian Penal Code. The prosecution case is that petitioner no. 4 Dharmendra Kumar came to the grocery shop of the informant and demanded articles on credit but it was refused when petitioner Dharmendra Kumar assaulted the informant with farsa and co accused Mrityunjay Kumar assaulted with lathi. When father of the informant came to rescue then Ramadhar Bhagat assaulted him, thereafter mother and sister of the informant came to rescue then
Patna High Court Cr.Misc. No.32524 of 2015 (2) dt.10-08-2015 2/2 they were abused by all the accused persons.
It is submitted by the learned counsel for the petitioners that the injury of the informant has been found to be simple though the opinion with regard to some of the injuries of the father of the informant have been kept reserved when other injuries have been found to be simple. It is further submitted that for the occurrence of 4.3.2015 the FIR has been registered on 6.3.2015 and the petitioners side has lodged case at earlier point of time. Considering the delayed lodging of the case and the case lodged by the petitioners side at earlier in point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Siwan in connection with Guthani P.S. Case No. 44 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
