The petitioner is an accused in connection with Dumra P.S. Case No. 227 of 2015, registered under Section 302/34 of the Indian Penal Code, pending in the Court of Addl. Sessions Judge-II, Sitamarhi.

Admittedly, the prayer for bail of the petitioner was refused earlier on merit vide order dated 26.04.2017 passed in Criminal Miscellaneous No. 6118 of 2017. A report, as called for, has been received to the Court of fast Track Court-II, Sitamarhi through Letter No. 26, dated 22.03.2018, which indicates that the record is fixed for recording the statement of the accused and the learned Fast Tract Court-II expected to conclude within

Patna High Court Cr.Misc. No.56555 of 2017(3) dt.28-03-2018 2/2 40 days.

Having considered the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for bail rejected. However, learned Fast Track Court-II, Sitamarhi is directed to conclude the trial of the petitioner within two months by taking all effective steps. If the trial of the petitioner is not concluded within two months, the petitioner would be at liberty to renew his prayer for bail.
