The petitioner is in custody in connection with Barachatti P.S. Case No. 05 of 2019, registered for the offence punishable under Sections 30 (A), 38, 47 of the Bihar Prohibition & Excise Amendment Act, 2016.
Learned counsel for the petitioner submits that in the instant case total 350 liters spirit was seized. Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. Counsel for the petitioner submits that petitioner is in custody since 05.01.2019. Considering the fact that nothing was recovered from the conscious possession of the petitioner and has remained in custody for more than two months, the court is inclined to grant
