The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 353 bottles each containing 180 ml, i.e., total 63.54 litres of foreign liquor was recovered from the tempo and the petitioner is said to be the driver of the said vehicle. Petitioner claims that he is having clean antecedent and is in custody since 30.08.2017, i.e., about three months.

No.55116 of 2017(2) dt.23-11-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions JudgeII-cum-Special Judge, Excise Act, Buxar in connection with Buxar (Town) P.S. Case No. 536 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
