Deceased Sushila Devi was done to death at her Sasural. Whereupon, her husband along with petitioner (Devar), Bhaisur, Gotani along with others have been arraigned as accused. From the place of occurrence incorporated under para 7 of the case diary it is evident that the petitioner has got independent identify at the eastern boundary of the place of occurrence.
Moreover, from the case diary it is also evident that no positive evidence has been collected against the petitioner. Moreover, the direction of the investigation suggests that one of the reasons for commission of the occurrence is on account of
Patna High Court CR. MISC. No.15779 of 2020(3) dt.06-07-2020 2/2 putting hindrance in the extra marital relationship of Baby Devi (elder Gotani of the deceased) with her husband. Para 55 of the case diary suggests the cause for death asphyxia due to strangulation.
In the facts and circumstances of the case, petitioner Binod Choudhary is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No.292 of 2019.
