JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Pachrukhi P.S. Case no. 116 of 2017, registered under Sections 147, 149, 341, 323, 186, 353 and 504 of the Indian Penal Code. The accusation is that on 07.056.2017 informant being the Circle Officer of Pachrukhi along with other officials went to Pachrukhi for measurement of auction land of Sugar factory as per the order of D.R.T. Patna. In course of measurement of the land, five persons named in the F.I.R. including the petitioners and 50 unknown persons reached there and started to create disturbance in the measurement. At that time, Umesh Singh abused and assaulted Anchal Amin Jamadar Ali and created nuisance there.

Learned counsel for the petitioners submits that while

Patna High Court Cr.Misc. No.55374 of 2017 (2) dt.28-11-2017 2/2 petitioners are named in the F.I.R. along with others as a member of the mob, but no specific overt act has been attributed against the petitioners. Further submission is that allegation of committing Marpit with Anchal Amin is against co-accused Umesh Kumar Singh. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Pachrukhi P.S. Case No. 116 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
