JUSTICE SANJAY KUMAR ORAL ORDER 24-07-2018 Heard the learned counsel for the petitioner as well as learned APP for the State.

The petitioner is in custody in connection with Maniyari P.S.Case No.230 of 2017 corresponding to GR No.2636 of 2017 pending in the Court of Sri Nayan Kumar, Judicial Magistrate, Ist Class, Muzaffarpur registered for an offence under Section 414 of the IPC and sections Arms Act.

As per FIR, this petitioner was apprehended by police in course of patrolling duty and from his possession one countrymade loaded fire arm was recovered. This petitioner, however, disclosed the name of other co-accuseds also who seeing the police party had fled away from the place of occurrence. The petitioner did not produce any paper with respect to the stolen motorcycle

Patna High Court Cr.Misc. No.38986 of 2018 (3) dt.24-07-2018 2/2 which was recovered from the possession of the petitioner besides that the petitioner is involved in two more cases. Considering the facts and circumstances of the case, prayer for bail is rejected. The court below is directed to expedite the trial.
