JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Runnisaidpur P.S. Case No. 508 of 2019, registered under Sections 25(1-B)A/26 and 35 of the Arms Act.

The accusation is that in course of patrolling duty, one person was seen at Katra turning, on seeing the Police vehicle he started fleeing with the motorcycle, while other person present there also started fleeing, but he was apprehended, who disclosed his name Salim Sah @ Alli Sah. The apprehended person also disclosed the name of Rakesh Paswan @ Rakesh Ram (petitioner), who succeeded to flee away with the motorcycle. On search, one country made pistol recovered from the possession of Salim Sah @ Alli Sah.

No.16040 of 2020(2) dt.04-06-2020 2/2 Learned counsel for the petitioner submits that petitioner was not apprehended on the spot, rather, his name has been disclosed by co-accused Salim Sah @ Alli Sah. The petitioner has no criminal antecedent and he is in custody since 04.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 508 of 2019 (G.R. No. 4689 of 2019).
