2. Counsel for the petitioner submits earlier the prayer for bail of the petitioner was rejected vide order dated 29.11.2022 passed in Criminal Miscellaneous No. 64612 of 2021 and thereafter vide order dated 21.06.2023 passed in Criminal Miscellaneous No. 24478 of 2023 in which the trial Court was directed to expedite the trial within six months in connection with Sessions Trial No. 421/2021, arising out of Kalyanpur P.S. Case No. 89/2021, pending before the learned 14th Addl. Sessions Judge, East Champaran, Motihari.

3. Learned counsel for the petitioner further submits that six months' time has already been lapsed and on the previous occasion, a report with regard to the present status of the case has been called for.

4. From the status report, it becomes clean that out of

Patna High Court CR. MISC. No.23918 of 2024(3) dt.10-05-2024 2/2 eight chargesheet witnesses, five witnesses have already been examined and the rest three witnesses including the I.O. and the informant are yet to be examined.

5. In this background, it is directed to the trial Court to conclude the trial within three months from today. If the said trial shall not conclude within three months, the trial Court shall release the petitioner on bail, in connection with Sessions Trial No. 421 of 2021 on his/her satisfaction and imposing its own conditions, so that the petitioner may not evade appearance during trial.

6. Accordingly, the present application stands disposed off.
