The present writ application has been filed for a direction to the respondents not to interfere with the possession of the petitioner over the land appertaining to old Plot Nos. 664, 669, New Plot No. 216 and 219 situated in village Pratapi, P.S. and Circle- Barachatti, District- Gaya, for which a decree has been passed in T.S. No. 176 of 2005 in his favour. In view of the fact that the District Forest Officer filed Title Appeal No. 36 of 2013 in the Court of learned District Judge, Gaya against the judgment and decree passed in Title Suit No. 176 of 2005, the petitioner has a remedy to agitate the issue
Patna High Court CWJC No.12168 of 2016 (2) dt.29-08-2016 2/2 before the appropriate appellate forum.
Considering the aforesaid fact, this application is disposed of with a liberty to the petitioner to agitate his claim before the appropriate forum.
