JUSTICE SANJAY PRIYA ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chapra Rail P.S. Case 26 of 2017 instituted for the offence under Section 379 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from his possession. His name has come during investigation on the basis of confessional statement of co-accused Mantu. Counsel for the petitioner further submits that petitioner is in custody in the instant case since 22.01.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.48757 of 2018 (2) dt.26-09-2018 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate (Railway), Sonepur (Saran) in connection with Chapra Rail P.S.
