JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Special Case No. 5602 of 2017 arising out of Bikram P.S. Case No. 249 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation against the petitioner is regarding recovery of 1270 litres of illicit country made liquor from Bolero vehicle and tractor.
The learned counsel for the petitioner submits that the petitioner is not the owner of the Bolero vehicle and the tractor and he has got nothing to do with the alleged offence. It is submitted that the co-accused has already been granted bail by a
Patna High Court Cr.Misc. No.60746 of 2017 (2) dt.21-12-2017 2/2 coordinate Bench of this Court and the petitioner is languishing in custody since 29.08.2017 and he has got a clean antecedent. Considering the nature of accusation, the period of custody already undergone and the fact that he has got a clean antecedent, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 5602 of 2017 arising out of Bikram P.S. Case No. 249 of 2017.
