JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 120(B), 147, 148, 365 of the Indian Penal Code.

As per the prosecution case, the accused persons including this petitioner are alleged to have kidnapped and concealed the informant's husband.

Learned counsel for the petitioner submits that after three days of the husband of the informant going missing, a station diary entry was recorded at the instance of the son of the informant stating that his father remained under mental stress and strain and he may have left for some unknown destination. It has also been submitted that during the course of investigation, nothing has been collected against the petitioner.

Misc Nos. 18950 of 2019 and 13474 of 2021. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Daudnagar, Aurangabad in connection with Obra P.S. Case No. 269 of 2018 arising out of Complaint Case No. 370 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
