JUSTICE VIKASH JAIN ORAL ORDER 28-01-2015 Heard learned counsel for the petitioner and learned APP for the State assisted by learned counsel for opposite party no.2.

2. The petitioner apprehends his arrest for the offences alleged under Section 498(A) of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act registered in connection with Complaint Case No. 394 of 2013.

3. It is submitted that the parties were married about four years ago. In any event, it is further submitted that the petitioner offers to deposit a sum of Rs.1000/- per month regularly for benefit of the opposite party no. 2.

4. Learned counsel for the opposite party no. 2 appears

Patna High Court Cr.Misc. No.15844 of 2014 (9) dt.28-01-2015 2/2 and has been heard.

5. Having regard to the entirety of the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner by order dated 09.04.2014 pending in the Court of learned Sub-Divisional Judicial Magistrate, Rohtas at Sasaram in connection with Complaint Case No.394 of 2013 is hereby confirmed, subject to further condition that the petitioner will deposit a sum of Rs.1000/- per month regularly before the learned Court below which shall be available for withdrawal by opposite party no.2 and upon failure to deposit any two consecutive instalments, his bail bond shall stand automatically cancelled.
