The petitioner apprehends his arrest in a case under Sections 406, 409, 420, 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner had to deliver 233.20 metric tones of rice, value of which is Rs. 50,50,085.92; out of which, the petitioner has already deposited Rs. 10,25,000/-. It is submitted that there is a violation of the terms of agreement. The petitioner has already deposited 20% of the total amount and she is ready to deliver the rice, which is kept in the godown of the petitioner, as and when required by the B.S.F.C.
Considering the fact that the petitioner has already deposited 20% of the total amount and she is also ready to deliver

No.28185 of 2015 (2) dt.17-07-2015 2/2 the rice, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West, Supaul in Supaul P.S. Case No. 229/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
