The present application has been filed on behalf of the petitioner, under Section 25(1)(a) of the Code of Civil Procedure, to transfer the Matrimonial Case No. 17 of 2014 filed by the husband of the petitioner (opposite party), under Section 9 of the Hindu Marriage Act, from the court of Principal Judge, Family Court, Muzaffarpur to the court of Principal Judge, Family Court, Patna. Learned counsel for the petitioner submits that
Patna High Court MJC No.1836 of 2014 dt.16-02-2015 petitioner is a lady and mother of a small child, who will have to face lot of problem to pursue a case at Family Court, Muzaffarpur, whereas petitioner and her husband (opposite party) are available at Patna due to their respective services at Patna.
Learned counsel for the opposite party (Mukesh Kumar Verma) has accepted about filing of the aforesaid Matrimonial Case No. 17 of 2014 in the court of Principal Judge, Family Court, Muzaffarpur, under Section 9 of the Hindu Marriage Act, and submits that he has no objection, if the Matrimonial Case No. 17 of 2014 is transferred from the court of Principal Judge, Family Court, Muzaffarpur to the court of Principal Judge, Family Court, Patna. In view of the aforesaid submission, let the Matrimonial Case No. 17 of 2014 ( Mukesh Kumar Verma versus Meeli Sinha) be transferred from the court of Principal Judge, Family Court, Muzaffarpur to the court of Principal Judge, Family Court, Patna for disposal.
