JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 The petitioner is apprehending her arrest in connection with Jamalpur P.S. Case No. 24 of 2015 for the offences instituted under Sections 147, 149, 323, 341, 504, 307, 506 and 379 of the IPC.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that while the informant was ploughing his field all the accused persons came armed with Iron rod, Farsa, Lathi and Danda and abused the informant and told the informant not to plough the field and on protest co-accused Mukhtar Ansari gave Farsa blow on the informant's head as a result of which he fell down on the ground. Sahadat Ansari assaulted the informant with Iron rod on the back
Patna High Court Cr.Misc. No.29170 of 2015 (2) dt.27-07-2015 2/2 and Fulo Ansari took out Rs. 2,000/- from the informant and others assaulted with fists and slaps.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the main allegation is against Mukhtar Ansari. As far as the petitioner is concerned, she is a lady and she has falsely been implicated in the present case as she had instituted Jamalpur P.S. Case No. 23/2015.
On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Jamalpur P.S. Case No. 24 of 2015(G.R. No. 240/2015) on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Biraul at Benipur, Darbhanga, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
