Petitioner being husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 352, 498A, 504/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that present complaint was filed on 16.09.2013 whereas the complainant has filed Matrimonial Suit No. 64 of 2015 on 12.03.2015 for dissolution of marriage. The same has brought on record as Annexure-2. It is further submitted that petitioner after receiving gunshot injury immediately after marriage is leading a disabled life.

No.31950 of 2015 (2) dt.06-08-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sadar, Motihari in connection with Complaint Case No. C-2330 of 2013, arising out of Trial No. 6040 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
