In this case, the petitioner is seeking regular bail in connection with Mahua P.S. Case No. 42 of 2019 registered for offence punishable under section 392 of the Indian Penal Code and later on section 395 of the Indian Penal Code has been added.

Allegation has been made that the accused persons, on 16.02.2019 at about 9:30 A.M., entered into the LIC office, Goraul settalite/branch, district-Vaishali and they committed robbery of Rs.8,16,242/- and Rs.1,30,551/-. They also took three cheques. At the time of lifting, they took C.C.T.V. camera and Hard Disk and closed all the staffs in a room. Learned counsel for the petitioner submits that save and except confessional statement of co-accused Rahul Kumar,

No.20655 of 2020(8) dt.06-01-2021 2/2 no incriminating material has been recovered from him nor the police has conducted T.I. parade and the other co-accused persons, namely, Rahul Kumar, Mukesh Kumar Singh, Sanjay Singh, Deepak Kumar Rai, Suraj Kumar @ Ravi Kumar and Ajit Kumar have been granted bail by different coordinate Benches of this Court in Cr. Misc. No. 1861 of 2020, Cr. Misc. No.13115 of 2020, Cr. Misc. No. 72126 of 2020, Cr. Misc. No. 1038 of 2020, Cr. Misc. No. 7728 of 2020 and 26743 of 2020. The petitioner is in custody since 18.07.2019. Looking to the facts and circumstance of the case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.

10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 42 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
