The petitioner seeks regular bail in connection with Bettiah Town P.S. Case No.306 of 2016 registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the servant of the informant was found dead in front of his house with gun shot injuries. The F.I.R. has been registered against unknown. During course of investigation, Prakash Patel, Kunal Thakur and Bharat Patel confessed their complicity and also disclosed the name of this petitioner. It has been submitted that there is no material to connect the petitioner with the crime. Although the petitioner has been made accused in

Patna High Court Cr.Misc. No.60542 of 2017 (2) dt.19-12-2017 about five other cases but in most of the cases he is on bail. The co-accused Kunal Thakur has been allowed bail in Cr.Misc.No.48777 of 2017 by one of the coordinate Bench of this Court on 01.12.2017. The case of the petitioner stands on similar footing and he is in custody since 24.06.2017. The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No.306 of 2016, subject to the condition that one of the bailors should be close family members of the petitioner.
