ANJANA MISHRA ORAL ORDER 09-09-2015 Heard learned counsel for the petitioner and the learned counsel for the Bihar State Food Corporation as well as the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Daudnagar P.S. Case No.107 of 2015 for allegedly having committed the offence under Sections 406, 409 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is facing prosecution on account of non-supply of rice in lieu of paddy received by him. The loss, which has been quantified in the F.I.R., is to the tune of Rs.1,47,97,289/-. Learned counsel for the petitioner further submits that earlier the
Patna High Court Cr.Misc. No.30589 of 2015 (3) dt.09-09-2015 2/2 BSFC had filed a certificate case after quantifying the loss to be Rs.1,46,97,289/-. While the said case was pending, the petitioner moved this Court and thereafter a sum of Rs.46,70,000/- was deposited with the BSFC.
Learned counsel appearing of BSFC submits that the present F.I.R. is with regard to Rs.1,94,17,289/-. After deducting the amounts paid by the petitioner, the present F.I.R. has been lodged with regard to the amounts stated i.e., Rs.1,47,97,289/-. However, considering the fact that the petitioner has deposited more than 20% of the amount, as alleged, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No.107 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
