Petitioner apprehends his arrest in a case registered under Sections 341, 323, 324, 307, 385, 504 of the Indian Penal Code.
Informant has alleged in his fardbeyan that while he was working in his tea shop, petitioner and his associates came there and demanded Rangdari of Rs. 5000/- and also petitioner attacked him by means of knife in the lower portion of his stomach and he suffered sharp cutting injuries. It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case due to land dispute between the parties. There was dispute with respect to sale and purchase of land adjoining the house of informant and
Patna High Court CR. MISC. No. 28101 of 2021(3) dt.21-10-2021 2/2 on account of such dispute there was some scuffle between them, as a result of which he fell down and suffered minor injuries. It has been further submitted that injury is stated to be simple in nature. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur, in connection with Mahnar P.S. Case No. 18 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
