The petitioner is accused in connection with Kanti P.S. Case No. 831 of 2019 for the offence registered under Sections 412, 413, 414, 467, 468, 472, 471/34 of the Indian Penal Code and Sections 25(1-b)A, 26, 35 of the Arms Act pending in the Court of S.D.J.M., (West), Muzaffarpur. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and have falsely been implicated in the present case. It is further submitted that nothing incriminating article has been recovered form the conscious possession of the petitioner. Petitioner is in custody since 11.11.2019.

Patna High Court CR. MISC. No.17466 of 2020(3) dt.02-07-2020 2/2 Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that there is involvement of the petitioner in the alleged occurrence. He further submits that petitioner has been made accused in several cases, i.e. 34 cases, as contained in paragraph no.3 of the bail petition. Hence, this is not a fit case for bail. Having considered the facts and circumstances of the case and the submissions advanced on behalf of the A.P.P., this Court is not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for bail is rejected. (Arvind Srivastava, J) shailendra/- U T
