Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 420, 406, 506/34 of the Indian Penal Code.

Complainant Sunita Devi in her complaint petition has alleged that she is working as Anganbari Sevika and she approached father of petitioner no. 1, Anand Mohan Singh, for purchase of land for which he agreed and in consideration thereof she paid Rs. 85000/- to accused-Anand Mohan Singh and thereafter sale deed was executed in her favour. However, when she came to know that execution of sale deed by Anand

No.29281 of 2021(2) dt.25-10-2021 2/2 Mohan Singh does not confer any title to her as Anand Mohan Singh had lost the title suit with respect to said land, thereafter she went to Anand Mohan Singh, to refund her consideration amount but he refused to refund the said amount. It is submitted by learned counsel for the petitioners that there is no specific allegation against these petitioners of cheating or any consideration amount being paid to them by the complainant or they influenced complainant to purchase the land. Petitioner no. 1 is a government servant. Petitioners have got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on anticipatory bail in the event of their arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bonds of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Complaint Case No. C1072 of 2014, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
