JUSTICE ARUN KUMAR ORAL ORDER 24-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sitamarhi PS Case No. 381 of 2017 registered under Sections 295(A), 298/34 of the IPC and Section 66A(a)(b) of I.T.Act.

The allegation in brief is that on the informant's mobile, who is a Police Officer, on his whats-App a video was sent in which a person naming himself as the petitioner was abusing against members of another religious community and making outrageous statement.

Learned Counsel for the petitioner submits that the mobile from which the whats-App message was sent is not of the petitioner. The petitioner is not in the video clip and the police has submitted charge-sheet in the case.

Having considered the said facts and circumstances, the petitioner, namely, Md. Ali Siddiqi @ Munna is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Sitamarhi in connection with Sitamarhi PS Case No. 381 of 2017.
