The petitioner seeks bail in a case instituted for the offences under Sections 447, 307/34 of the Indian Penal Code, 27 of the Arms Act, and 3 and 4 of Explosive Substance Act. The prosecution case in short is that while the informant was irrigating in his field, the accused persons variously armed came and assaulted him due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.11.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case

Patna High Court CR. MISC. No.20997 of 2019(4) dt.21-06-2019 2/2 due to previous enmity. There is no substantive evidence to suggest his implication in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. There is specific allegation of firing against the petitioner causing injury to four persons. The petitioner has criminal antecedents.

Considering the same, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to conclude the trial at the earliest. (Sudhir Singh, J) Pankaj/- U T
