1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Runnisaidpur Police Station Case No. 415 of 2024, disclosing offences under Sections 25(1-b)a, 26, 35 of the Arms Act.

3. As per the prosecution case, on 21.11.2024 at about 1.00 hour, the informant with other police forces were on night patrolling duty and saw that one person was going with a bag who was indicated to stop but he started fleeing away. He was apprehended by the police and on query he disclosed his name as Ram Sakal Mukhia. On search of him, a country made pistol and instruments made of iron were recovered. 4. Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. There is no direct evidence against the petitioner. Petitioner has no concern with the alleged seized country made pistol. Petitioner was not present at the place of occurrence. Nothing incriminating has been recovered from the conscious possession of the petitioner. Petitioner has been made accused on the basis of confessional statement made by the arrested coaccused namely Ram Sakal Mukhia who has inimical terms with the petitioner.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that petitioner is having criminal antecedent of serious nature of offence, I am not inclined to grant the petitioner privilege of anticipatory bail.
