The petitioner, already in custody, seeks bail in connection with Patepur P.S.Case No. 60 of 2018 registered under Sections 379 and 461 of the Indian penal Code. Accusation is that 32 mobiles were stolen from the shop of the informant and two empty boxes of two mobiles were recovered from the scrap (Kabari) shop of the petitioner. Submission is that petitioner runs a scrap (Kabari) shop and used to purchase all waste materials including the papers and other items, so except two empty boxes of mobiles of cardboard, there is no other recovery from the possession of the petitioner and he has no criminal antecedent of such nature except one against him of rape in which he is on bail. Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.46931 of 2018(2) dt.01-08-2018 2/2 the petitioner, namely , Mohammad Aslam, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Patepur P.S. Case No. 60 of 2018.
