This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Muzaffarpur Sadar PS Case No. 665 of 2018 for the alleged offence punishable under Sections 461 and 379 of the Indian Penal Code.
Learned counsel representing the petitioner submits that out of same occurrence two cases were registered including the present one. Another case is registered as Dumariya Ghat PS Case No. 146 of 2018. Petitioner was granted bail in the said case by this Hon'ble Court in Cr. Misc. No. 2432 of 2019 vide order dated 21.01.2019. He further submits that in the instant
Patna High Court CR. MISC. No.17768 of 2019(2) dt.26-03-2019 2/2 case petitioner is in custody on remand since 06.11.2018. Considering the fact that petitioner was granted bail in another case, i.e. in Dumariya Ghat PS Case No. 146 of 2018, and the present case is offshoot of the same transaction, the Court is inclined to release the petitioner on bail. This application is allowed.
Accordingly, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar PS Case No. 665 of 2018.
