The petitioner is in custody in connection with Birpur P.S. Case No.162 of 2017, a case under Sections 302/201/120B/379 of the Indian Penal Code.
Petitioner is suspected to have committed murder of the son of the informant for the reason that deceased was in love with the daughter of the petitioner, which was not liked by the petitioner.
Submission is that the case-diary would reveal that there is no direct evidence of murder. However, suspicion is against the petitioner and others of commission of honour killing and further suspicion is against some other set of accused vide
Patna High Court Cr.Misc. No.61618 of 2017 (3) dt.08-02-2018 P2/ para-19 of the case-diary.
Learned counsel for the informant opposed the prayer on the ground that the material has surfaced against named persons to be involved in the crime alleged. Hence, the petitioner does not deserve bail.
Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
