It transpires from the impugned order that the learned court below allowed the prayer of the plaintiff for restoration of the T.S. No. 103 of 2000. It has also been held that on the date when the suit was dismissed for default, it was not placed for hearing and, therefore, the order of dismissal of the suit was passed due to mistake and laches of the court. In view of the aforesaid facts and the reasons assigned in the impugned order, this Court finds that the learned court below has not committed any error in passing the impugned order.
