Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363/366(A) of the Indian Penal Code.
Informant is mother of the informant who has alleged in her written complaint that one co-villager, Sanjay Kumar Yadav (petitioner) has enticed away her daughter for second time on 03.09.2020 at about 4:00 a.m. in the morning. 10-11 days earlier also, petitioner had enticed away her daughter and subsequently both were brought in the police station and from there she took her daughter to her house. Thereafter, she send her daughter at the residence of her married daughter thinking

No.33124 of 2021(2) dt.28-10-2021 2/2 that petitioner will not go there but petitioner enticed away her daughter also from there and even after much search, when she did not return back, she has lodged the present FIR. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. Statement of victim girl has been recorded under Section 164 of Cr.P.C. in which she has admitted that petitioner resides adjacent to her house and both are well known to each other and have intimate relations. Petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail, in the event of his/her arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bhagwanpur Hat P.S. Case No.223/2020 subject to the condition as laid down under Section 438(2) of the Cr.P.C. (S. Kumar, J) Sanjay/- U T
