ANSARI ORAL ORDER 25-06-2015 This is an application, made under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail by the petitioners, namely, Urmila Devi and Manish Kumar @ Manish Kumar Tiwari, in connection with Mokama Police Station Case No. 117 of 2014 under Sections 304(B)/498(A)/34 of the Indian Penal Code.
Perused the above application and materials on record including a copy of the order, dated 20.02.2015, passed, in A.B.P. Nos. 24006, 24132 and 24304 of 2014, by the learned Additional Sessions Judge-X, Patna, dismissing the said application for prearrest bail and, order, dated 28.04.2015, passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.15451 of 2015 (2) dt.25-06-2015 2/3 16054 of 2015, by a Bench of this Court granting benefit of prearrest bail to the sister-in-law of the petitioner. Heard Mr. Surendra Kumar Singh, learned Counsel for the petitioners, and Mr. Ahmad Ali, learned Additional Public Prosecutor, appearing on behalf of the State. Considering the fact that petitioner No.1 is the mother-in-law of the alleged victim residing with her husband, who works in Bharat Cooking Coal Limited, and petitioner No.2 is brother-in-law of the alleged victim coupled with the fact that similarly situated co-accused has been granted benefit of pre-arrest bail by a Bench of this Court by order, dated 28.04.2015, passed in Cr. Misc. No.
16054 of 2015, it is hereby, in the interest of justice, directed that the petitioners above-named shall, in the event of their arrest in connection with the case aforementioned, be released on bail of Rs. 10,000/- , with two sureties of the like amount each, subject to the satisfaction of the Officer-in-Charge, Mokama Police Station, District-Patna.
Patna High Court Cr.Misc. No.15451 of 2015 (2) dt.25-06-2015 3/3 threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer.
This application for pre-arrest bail shall stand disposed of in terms of the above observations and directions.
