JUSTICE SHIVAJI PANDEY ORAL ORDER 23-08-2017 Heard Learned counsel for the petitioner and learned counsel for the State as well as BSFC.

The petitioner has come with an offer to liquidate the outstanding dues as on today in three installments with the gap of three months each.

The petitioner is a miller and could not supply the requisite amount of CMR which led to initiation of a proceeding under PDR Act. Petitioner has received a notice for payment of Rs.30,11,583/- and he submits that he has

Patna High Court CWJC No.10544 of 2016 (3) dt.23-08-2017 already paid amount of Rs. 18 lacs. Rest amount he is ready to pay in three installments with the gap of three months each. In such view of the matter, the present writ petition is disposed of with a direction that petitioner should liquidate outstanding dues as on today in three installments with the gap of three months each. But if the petitioner fails to pay the installments the Certificate Officer will be at liberty to take coercive action against him with respect to certificate case. With the aforesaid observation and direction this writ petition is disposed of.
