The petitioner seeks bail in Amnour P.S. Case No. 164 of 2014 (S.T. No. 224 of 2015) (G.R. No. 6360 of 2014) instituted for the offences under Sections 147, 148, 149, 307, 302, 120B/34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 11(1)A and 18 of Unlawful Activities Act. The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application as the petitioner being one of the assailants. This is second attempt on behalf of the petitioner for grant of bail.

A report was called for from the Trial Court. It has been reported that out of four prosecution witnesses, three witnesses have already been examined and further I.O. and Doctor are also yet to be examined. Summons have already

No.62461 of 2017(3) dt.28-03-2018 2/2 been issued through the Superintendent of Police and Civil Surgeonj upon the I.O. and the Doctor and Non-bailable warrant has been issued upon the remaining prosecution witness. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial within a period of 7 months preferably on day to day basis from the date of receipt/production of a copy of this order.

The District Magistrate, Saran at Chapra, the Superintendent of Police, Saran at Chapra and the Civil Surgeon, Saran at Chapra are also directed to ensure the presence of the remaining witnesses on the date fixed in the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Saran at Chapra, the Superintendent of Police, Saran at Chapra and the Civil Surgeon, Saran at Chapra.
