The petitioner seeks bail in connection with Bandhuwa Kurawa P.S. Case No. 32 of 2017 registered for the offence punishable under Section 366(A) of the Indian Penal Code.

Informant is the father of the victim girl, who has stated in his fardbeyan that on 23.06.2017 his daughter Afsana Khatoon aged about 16 years had eloped with the petitioner and even after much search when she was not found then the present FIR was lodged. The victim girl has been recovered and she has stated in her statement under Section 164 of the Cr.P.C that she had solemnized marriage with the petitioner and had accompanied him with her own sweet will and they are living

Patna High Court Cr.Misc. No.61143 of 2017(3) dt.16-01-2018 2/2 together as a married couple. She has further Stated that she wants to live in her matrimonial home and does not want to go with her parents as they want to sell her. Petitioner is in custody since, 25.06.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-III, Banka in connection with Bandhuwa Kurawa P.S. Case No.32 of 2017.
