JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Amarpur P.S. Case No.215 of 2017, a case under Sections 366A/363 of the Indian Penal Code.

The F.I.R. was lodged with allegation that the petitioner and five others forcibly kidnapped to the daughter of the informant. The victim girl in her statement under Section 164 Cr.P.C. leveled allegation only against the petitioner. However, a perusal of her statement reveals that she never protested against movement at different place along with the petitioner. Submission is that the matter is of love-affairs. However, under pressure of the parents, the victim has given her statement under Section 164 Cr.P.C.

No.61357 of 2017 (2) dt.19-12-2017 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Amarpur Police Station Case No. 215 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
